Terms and Conditions
BOOKING CONDITIONS
for Villa No. 30, Phase Two, Calahonda, Spain
In these Conditions the expression "The Lessee" shall also be understood as appropriate to include every other person occupying the Villa; who shall be equally liable for the observance of these conditions.
1. All bookings are made in good faith, and the Owner will not be responsible for any problems occasioned by any cause or circumstance beyond his sole and direct control.
DEPOSIT & PAYMENT
2. A Deposit of is payable at the time of making the Booking. No reservation can be made until this is received, and the Owner accepts no responsibility for loss of booking resulting from failure to pay the Deposit at the proper time.
3. The balance of the Rental is due twenty-eight days before the commencement of the Rental Period. If it is not received by close of business on that day the Booking is automatically cancelled, and any Deposit already paid is forfeit.
4. The full rental is payable at the time of booking for all bookings made within one calendar month of the commencement of the Rental Period.
5. Bookings cancelled more than three calendar months before the start of the Rental Period will receive a refund of #75; cancellations made between three months and one month before the start of the Rental Period will receive a refund of #50; and cancellations made less than one month before the start of the Rental Period will be charged at the full Deposit.
CONDITION & MAINTENANCE
6. The Owner will ensure that the property is properly cleaned and prepared before the arrival of the Lessee at the commencement of the Rental Period; such preparation to include maiding of the Villa, and the provision of clean towels, bedding, and other household linen.
7.The Lessee shall be responsible for ensuring that the Villa is left in a clean and tidy condition at the end of the Rental Period; with the towels, bedding, and other linen changed, and the kitchen and bathrooms in a clean condition; and he accepts liability for the cost of any additional maid service made necessary by their failure in this respect.
8. The Lessee shall ensure that any mishap, accident, or damage to the Villa or its contents, or to any person whomsoever (excluding minor personal injuries to the Lessee and any other resident of the Villa) shall be reported as soon as possible thereafter to the Owner s representative in Spain, whose details are prominently displayed in the Villa.
LIABILITY
9. The Lessee accepts full and unconditional liability for the results of his own conduct during his tenancy of the Villa, and agrees that no circumstance or consequence of his conduct or actions shall give rise to any claim against the Owner, however incurred.
10. The Lessee understands that, in the event of any circumstance arising where any question of liability may arise, including (but not limited to) accident, injury, or criminal activity, he shall make no admission of liability, either as to his own part or as to the Owner or any other person whatsoever, until he has duly notified the Owner s agent in Spain of the circumstances, and (if possible) also the British Consul.
